When injured on the job, there are some important things you must do and know.

First, you should know that you have time limitations in giving your employer notice of your injury, 45 days in Illinois.  There is another time limitation, three years, in filing your claim.  Many times the employee loses his rights because he is unaware of the 45 day notice requirement.

Second, you should know that in many workers compensation claims a third party (someone other than your employer) may be responsible for your injury.  This allows you to file both a workers compensation claim and a third party claim for the same injury. 

Third, you should know that it is illegal for your employer to fire you because you want to or have filed a workers compensation claim. 

Fourth, you should know that you have the right to retain legal counsel for your workers compensation claim.

This is what you should do.

First, you should give your employer immediate notice of your injury as soon as you know of the on the job injury.  You have 45 days to do this but you should do this immediately.

Second, you should seek medical treatment immediately.  Emergency care does not require notification to the carrier or the employer.  However, make sure you notify the carrier as soon as possible.
