UNDER-INSURED MOTORIST

When injured by an under-insured motorist there are some important things you must do and know.

First, you should know that if you were injured by an under-insured motorist, you have the right to file a claim for under-insured motorist benefits with your insurance company.

Second, you should know that filing a claim for under-insured motorist benefits is highly technical.  Before you can file a claim for under-insured motorist benefits, you must first exhaust the limits of the other driver’s insurance policy.

Third, you should know that your insurance company in an under-insured motorist claim is your adversary and that your insurance company will make you prove each and every element of your claim, including that the other driver was fault or that you sustained injuries.

Fourth, you should know that you do not have to accept what your insurance carrier offers you for your under-insured motorist claim and that you have the right to have your claim for under-insured motorist benefits arbitrated  

This is what you should do.

First, you should get the names and addresses of all witnesses.

Second, you should contact your insurance company that same day and advise that you are filing under the under-insured provisions of your policy.  When doing this, do not give your insurance company a statement or allow them to record your statement as they are a potential defendant.

Third, you should seek medical treatment immediately if you are injured.  You should report to the doctor all parts of your body that are affected, even if the injury does not seem severe.  Days later, the same injury that you thought was minor might be serious.

Fourth, you should take pictures of your car. 

Fifth, you should ascertain the policy limits on your insurance policy and compare that to the policy limits of the other driver’s insurance policy.
