SLIP AND FALL INJURIES
When injured as a result of a slip and fall accident there are some important things you must do and know.
First, you should know that slip and fall cases can be very difficult cases. Before one can recover, it must be proved that the property owner had “notice” of the defective or dangerous condition and had sufficient time to make the necessary repair.
Second, you should know that the insurance company will try to put the blame on you. You must prove that you did not knowingly assume the risk of entering a dangerous area or to walk upon a slippery or defective surface. You must also prove that you were paying adequate attention to your surroundings.
This is what you should do.
First, you should get the names and addresses of all witnesses. The property owner or its employees cannot be counted on to be your witness.
Second, you should give notice of your injury to the owner of the premises immediately, before leaving the scene of the accident. Make sure a written report of the incident is made. It is crucial that the written report identifies exactly what caused you to fall. Try to obtain a copy of that report.
Third, seek medical treatment immediately if you are injured. You should identify all parts of your body that are affected, even if the injury does not seem severe. Days later, the same injury that you thought was minor might be serious.
Fourth, you should take pictures of the scene, focusing on what caused you to fall.
